Public Domain Spotlight: Popeye

Over the last few years we have seen many new characters enter the public domain including Winnie-the-Pooh in 2022, Mickey Mouse in 2024, and now, Popeye in 2025! The character emerged from a comic strip called Thimble Theater, which was started in 1919 and originally centered around the characters Ham Gravy and Olive Oyl. Popeye made his first appearance in the series as a minor player in early 1929, and as his popularity grew, he later became the central focus of the comic.

Let’s take a look at who Popeye was as a character in 1929:

January 17, 1929

In his very first appearance, Popeye shows off his thorny side by retorting Castor Oyl’s question with a sly remark about being a cowboy. The strip also shows him in a traditional all white sailor get-up that does not reflect his later appearance.


February 14, 1929

Popeye wears a black shirt for the first time, which is more in line with his iconic appearance.


February 18, 1929

Popeye throws his first ever punch. This time against Ham Gravy, one of the main characters of the strip at this point. The title, “That Sailor’s No Gentleman”, is indicative of Popeye’s rough and tough demeanor that would come to define the character.


June 11, 1929

After being shot repeatedly nearly a month earlier, in May 1929, Popeye reemerges full of bullet holes to knock down a foe. His displays of super strength do not originate from spinach, but possibly from rubbing the head of the Whiffle Hen (as seen on May 16, 1929).


June 15, 1929

Olive Oyl displays her first inclinations of romantic interest toward Popeye stating she would like to give him a kiss. The two do not become romantically involved in 1929, but the seeds were planted early.


June 27, 1929

This strip sees Popeye leave until August. However, his departure is not even the main appeal of the strip as it instead focuses on Olive Oyl’s purchase of new clothing. This focus and Popeye’s long absence, he is gone for all of July, thus implies that he was not meant to be a long lasting character, but only around temporarily.


August 5, 1929

Following over a month-long absence, Popeye returns to help Castor Oyl determine if Olive’s new boyfriend is only there for her money. His return indicates his overwhelming popularity with the public that was soon to transpire into his status as unchallenged main character of the strip. The title of this strip too foreshadows this shift being titled: Popeye’s The Man.


August 27, 1929

Olive Oyl displays her first show of affection to Popeye with a kiss. Though this was a mistake as she believed Popeye to be someone else. Despite this, it is yet another early indicator of their soon to be romance.


October 12, 1929

Popeye and Castor Oyl set off to locate Castor’s newly purchased brass mine. Their duo pairing indicates Popeye’s increased status and stature within the strip as Castor was the undeniable main character of the strip up to this point. Popeye’s appearance here again followed a brief absence from the strip dating back to September 30, 1929.


October 22, 1929

Popeye and Castor discover that where the brass mine ought to be is instead a farmer. Popeye implores Castor to allow the farmer to stay on the land, thus showing off his tender heart. Notably this strip takes place just two days before Black Thursday, the start of the Wall Street crash of 1929.


November 4, 1929

This strip shows off a bit more of Popeye’s peculiar dialect and his penchant for curving authority. In the strip he asserts that he is only going to jail because Castor has implored him to.

The title of the panel, “That Jailer’s No Postage Stamp”, also appears to be a humorous play on odd dialects installing postage stamp in lieu of “sap”. In 1920s slang, sap referred to a foolish or gullible person. The title’s swapping of the two terms is reflective of Popeye’s own tendency to swap out words with similar meaning as a postage stamp and sap are both sticky.


November 7, 1929

Another display of Popeye’s superhuman strength as he rips the bars off the jail cell.


Throughout 1929, Popeye not only showcased his superhuman strength and distinctive wardrobe but also his unique dialect and a characteristic phrase, “blow me down.” These foundational elements of his character, present from his very inception, have now entered the public domain. As we continue to engage with and reinterpret Popeye in modern contexts, there are some complexities. 

Jennifer Jenkins, director of Duke Law’s Center for the Study of the Public Domain, explains the following in regards to character copyrights in a post from 2025:

“First, under US copyright law, anyone is free to use characters as they appeared in public domain works. If those characters recur in later works that are still under copyright, the rights only extend to the newly added material in those works, not the underlying material from the public domain works—that content remains freely available.

Second, with newer versions of characters, copyright only extends to their features that qualify for protection. It is not enough for the new material to be different. The features must be “original, creative expression,” meaning that they were independently created (as opposed to copied from somewhere else) and possess at least a modicum of creativity. Mere “ideas” such as generic character traits are not copyrightable. Nor are “merely trivial” or “minuscule” variations added to the original characters. In addition, using commonplace elements that have become standard or indispensable (copyright law calls these “scènes à faire”) is not infringement.”

As beloved characters enter the public domain, modern creators can give them a new gloss, recontextualizing them for a new audience. One memorable example is a 2023 horror movie starring a much darker vision of Winnie the Pooh: “Blood and Honey.” We look forward to seeing what modern reinterpretations of Popeye arise, now that his fundamental character traits belong to everyone as part of the public domain.

Weird Tales from the Public Domain: Freeing Culture from Corporate Captivity

The mouse that became Mickey will finally be free of his corporate captivity as the copyright term of the 1928 animated Disney film, Steamboat Willie, expires along with that of thousands of other cultural works on the first day of 2024.

The year 1928 brought us a host of still relevant, oft-revived and remixed culture, from H.P. Lovecraft’s classic horror story, “Call of Cthulhu” (originally published in Weird Tales; now currently a popular video game), to the Threepenny Opera, a critique of income inequality and the excesses of capitalism that is surprisingly on point for our current era.

And further, classic works of literature such as Orlando by Virginia Woolfe, Well of Loneliness by Radclyffe Hall, and Black Magic by Paul Mourad; children’s literature like House on Pooh Corner by A. A. Milne, which introduced the character Tigger, and Millions of Cats by Wanda Gág; movies like Charlie Chaplin’s The Circus, and Buster Keaton’s The Cameraman; and music like Dorothy Field’s “I Can’t Give You Anything But Love, Baby” and Cole Porter’s “Let’s Do It, Let’s Fall in Love” will grow the rich set of materials that are freely available to all of us as part of the public domain.

Public Domain Day 2024 Remix Contest: The Internet Archive is Looking For Creative Short Films Made By You!

The Cameraman – 1928 – Buster Keaton

We are looking for filmmakers and artists of all levels to create and upload short films of 2–3 minutes to the Internet Archive to help us celebrate Public Domain Day at our celebrations on January 24 (in-person screening & party) & January 25 (virtual celebration), 2024!

Our short film contest serves as a platform for filmmakers to explore, remix, and breathe new life into the timeless gems that have entered the public domain. From classic literature and silent films to musical compositions and visual art, the contest winners draw inspiration from the vast archive of cultural heritage from 1928. We want artists to use this newly available content to create short films using resources from the Internet Archive’s collections from 1928. The uploaded videos will be judged and prizes of up to $1500 awarded!! (see details below)

Winners will be announced and shown at the in-person Public Domain Day Celebration at the Internet Archive headquarters in San Francisco on January 24, 2024, as well as our virtual celebration on January 25. All other participating videos will be added to a Public Domain Day Collection on archive.org and featured in a blog entry in January of 2024.

Here are a few examples of some of the materials that will become public domain on January 1, 2024:

Guidelines

  • Make a 2–3 minute movie using at least one work published in 1928 that will become Public Domain on January 1, 2024. This could be a poem, book, film, musical composition, painting, photograph or any other work that will become Public Domain next year. The more different PD materials you use, the better!
    • Note: If you have a resource from 1928 that is not available on archive.org, you may upload it and then use it in your submission. (Here is how to do that). 
  • Your submission must have a soundtrack. It can be your own voiceover or performance of a public domain musical composition, or you may use public domain or CC0 sound recordings from sources like Openverse and the Free Music Archive.
    • Note: Music copyright is TRICKY! Currently sound recordings published up to December 31, 1922 are public domain; on the upcoming January 1 that will change to sound recordings published up to December 31, 1923.  Sound recordings published later than that are NOT public domain, even if the underlying musical composition is, so watch out for this!
  • Mix and Mash content however you like, but note that ALL of your sources must be from the public domain. They do not all have to be from 1928. Remember, U.S. government works are public domain no matter when they are published. So feel free to use those NASA images! You may include your own original work if you put a CC0 license on it.
  • Add a personal touch, make it yours!
  • Keep the videos light hearted and fun! (It is a celebration after all!)

All submissions must be in by Midnight, January 19, 2024 (PST) by loading it into this collection on the Internet Archive.

Judges:

Judges will be looking for videos that are fun, interesting and use public domain materials, especially those from 1928. They will be shown at the in-person Public Domain Day party in San Francisco and should highlight the value of having cultural materials that can be reused, remixed, and re-contextualized for a new day. Winners’ pieces will be purchased with the prize money, and viewable  on the Internet Archive under a Creative Commons license.

Welcoming 1927 to the Public Domain

This year we are welcoming works from 1927 into the public domain in the United States, including books, periodicals, sheet music, and movies

Big events of 1927 include the first transatlantic phone call from New York to London, the formation of The Academy of Motion Picture Arts and Sciences, the first successful long distance demonstration of television, the release of the first popular “talkie,” The Jazz Singer, and the first nonstop transatlantic solo airplane flight, from New York to Paris, by Charles Lindbergh.

Movies

Despite the popularity of The Jazz Singer, movies were still mostly silent in 1927, including the gorgeous Metropolis by Fritz Lang. Laurel and Hardy’s first film, Putting Pants on Phillip, was released that year, along with an early Gary Cooper Western, Nevada, Joan Crawford in Spring Fever, Mary Pickford in My Best Girl, Clara Bow in Get Your Man, and Cecil B. DeMille’s King of Kings.

I was particularly taken with No Man’s Land, which gives top billing to a horse (Rex the Wonder Horse, in case you were wondering – if you’d like to follow his career he also starred in The King of Wild Horses and Black Cyclone). 

Or we can time travel with Koko the Clown in Koko in 1999 where they apparently thought that at the turn of the last century everything would happen via automation and you’d get a wife from a vending machine for 25 cents.  

Music

No new recorded music enters the public domain in the US this year — the next group of recorded music becomes available in 4 years, due to how the music modernization act is written — but we do have some fun new sheet music to explore. The biggies that are most remembered today are probably The Best Things in Life Are Free and I Scream, You Scream, We All Scream For Ice Cream. But you should also take some time to play Dream Kisses, The Desert Song, My Ohio Home, and Girl of My Dreams.

Thousands of issues of periodicals from 1927 are entering the public domain, some from titles that are still well known today like:

Books

The Sherlock Holmes books came to an end in 1927, and with it the release of The Complete Sherlock Holmes by Arthur Conan-Doyle (vol I and vol II). Other biggies include Death Comes for the Archbishop by Willa Cather and Mosquitoes by William Faulkner.

But as always, the most fun is to be had perusing the books from 1927 for hidden gems. Enjoy the gorgeous art deco designs in Ideas & studies in stencilling & decorating, for instance.

Virtual Gathering Welcomes Creative Works from 1926 into the Public Domain

Free from copyright restrictions, the public can now enjoy unlimited access to creative works from 1926 including A.A. Milne’s Winnie-the-Pooh, classic silent films with Buster Keaton, and jazz standards by Jelly Roll Morton.

A virtual party hosted by the Internet Archive, Creative Commons, and many other community co-sponsors on January 20 celebrated the availability of the newly released material. This year’s festivities also welcomed nearly 400,000 sound recordings from the pre-1923 era into the public domain as a result of the Music Modernization Act passed by the U.S. Congress.

“What a big win for our country, especially for libraries and archives that preserve our cultural history,” said U.S. Senator Ron Wyden (D-Ore.) of the newest crop of creative work entering the public domain, including the early sound recordings. “It’s also a big win for our artists, who can now freely use these classic recordings and transform them into new works.” [WATCH the segment with Senator Wyden.]

Wyden has supported groups that advocate for balanced copyright laws that support public access. In the recent federal legislation addressing compensation in the music industry, he pushed back against a provision that would have locked up older recordings for almost 150 years from their publication.

“These restrictions defied common sense, and they would have been a major disadvantage for historians, academics and American cultural heritage,” said Wyden, who helped secure a better deal that allowed sound recordings to be public property each year. “The Music Modernization Act was not our first rodeo, and I’m certain it is not going to be our last. I look forward to working with all of you closely in the days ahead, continuing the fight for balanced IP laws that work for all Americans.”

Meredith Rose, senior policy counsel with Public Knowledge, a consumer advocacy organization based in Washington, D.C., said the new federal legislation is a “huge game changer” for libraries. For the first time, sound recordings before 1972 can be made available for noncommercial and educational uses with no restrictions or threat of statutory damages. [WATCH this segment.]

Also speaking at the event was Jennifer Jenkins of Center for the Study of the Public Domain at Duke Law School. She shared a video highlighting the range of work becoming open this year from Ernest Hemingway’s first novel, The Sun Also Rises to the film “For Heaven’s Sake” with Harold Lloyd and poetry by Langston Hughes. “Public domain enables both creativity and access to preservation,” Jenkins said, noting some classic works have been lost to history. “For those that have survived, it’s time to discover or rediscover and breathe new life into them.”

A musical part of the program featured performances by Citizen DJ and Roochie Toochie and the Ragtime Shepard Kings.  There was also an interview with Colin Hancock, a musician and historian who has built his career playing early jazz, blues and ragtime music and using period technology to record it. Professor Jason Luther of Rowan University explained how his students research 78rpm records from the early 20th century through the Internet Archive’s Great 78 Project to create podcasts. Two of his students shared their excitement in being able to access these vintage recordings and make connections to artists’ work of today. (Read more about Luther’s project in this blog post.) The work of writers, musicians, filmmakers, scientists, painters should be consumed, built upon and enjoyed, said Catherine Stihler, chief executive officer of Creative Commons: “I see the public domain as a gift. A package of time, wrapped in excitement of discovery and revitalization that sheds light on the past and enriches the present.” [WATCH this segment.]

The Public Domain Day event was organized by the Internet Archive and co-sponsored by SPARC, Creative Commons, Library Futures, Authors Alliance, the Bioheritage Diversity Library, Public Knowledge, ARSC, the Duke Center for the Study of the Public Domain, and the Music Library Association.
